Rodrigues Ellis LLC (“Rodrigues Ellis,” “RE,” “we,” “us,” or “our”) respects the privacy of our customers and users. This Privacy Policy explains how we collect, use, store, disclose, and protect information when you use Rodrigues Ellis products and services, including RE Field, RE Dashboard, RE Assistant, our websites, and related services (collectively, the “Services”).

Our Services are designed primarily for businesses and their authorized personnel in the construction and related industries. In many cases, information submitted through the Services belongs to or is controlled by the organization that provides you access to RE.

By accessing or using the Services, you acknowledge the practices described in this Privacy Policy.

1. Information We Collect

The information we collect depends on how you and your organization use the Services.

Account and Profile Information

When an account is created, we may collect information such as:

• Name

• Email address

• Organization or company

• User role and permissions

• Account identifiers

• Authentication and login information

• Profile information provided by you or your organization

Passwords are handled through our authentication provider and are not stored by Rodrigues Ellis in plain text.

Organization and Project Information

Organizations and their authorized users may create, upload, enter, or generate information relating to construction projects and field operations, including:

• Project names and locations

• Project descriptions

• Crew and personnel information

• Daily reports and field logs

• Observations

• Notes and comments

• Work schedules

• Time and attendance records

• Inventory and material information

• Material requests and orders

• Photographs

• Videos

• Voice input and transcriptions

• Drawings, plans, specifications, and other documents

• AI-generated analyses, summaries, recommendations, and other content

• Other project-related records submitted through the Services

We refer to this information collectively as “Project Data.”

Photos, Video, Camera, and Media

RE Field may allow users to take photographs, record videos, or select existing media from their device.

Photos and videos may contain information beyond the intended subject, including people, voices, equipment, jobsite conditions, documents, identification markings, geographic surroundings, or other potentially identifiable information.

Media submitted to RE may be stored as part of the applicable project record and made available to authorized users of that organization or project.

RE does not access your device camera, photos, or media unless permitted by you through your device settings and required for a feature you choose to use.

Microphone and Voice Information

Certain RE features allow users to provide information using their microphone, including speech-to-text, voice commands, observations, and video recordings.

Voice information may be processed to transcribe speech, execute requested actions, generate project records, or provide AI-assisted features.

Voice recordings used solely for transcription may be processed for the requested feature without being retained as a separate audio recording. Audio that forms part of a user-submitted video or other stored project record may be retained with that record.

Location Information

With device permission, RE Field may collect location information when location-enabled features are used.

For example, location information may be associated with an observation or project record to document where field activity occurred.

We do not use location information for advertising.

If future RE features use background location, geofencing, or continuous location services, we will provide appropriate disclosures and permissions before enabling those features.

Device, Usage, and Diagnostic Information

We may automatically collect limited technical information necessary to operate, secure, monitor, and improve the Services, including:

• Device and operating system information

• Application version

• Login and authentication events

• Feature usage

• Error and crash information

• Performance and latency information

• Network or connection information

• Security events

• AI model usage

• Token usage and estimated AI processing costs

• Technical identifiers necessary to operate the Services

We use this information for purposes including troubleshooting, security, reliability, performance improvement, capacity planning, product development, and operational cost management.

2. How We Use Information

We use information collected through the Services to:

• Provide and operate RE Field, RE Dashboard, RE Assistant, and related Services

• Authenticate users and maintain accounts

• Enforce organization, project, and user access permissions

• Store and manage project records

• Generate daily reports, observations, analyses, summaries, and recommendations

• Process photographs, videos, voice input, documents, drawings, and specifications

• Provide AI-assisted functionality

• Process inventory, material, and field requests

• Support timekeeping and work-management functionality

• Synchronize information between RE products

• Diagnose errors and improve reliability and performance

• Protect the security and integrity of the Services

• Prevent fraud, misuse, and unauthorized access

• Provide customer support

• Improve and develop our products

• Monitor AI usage and operational costs

• Comply with applicable legal obligations

• Enforce our agreements and protect our legal rights

We do not sell personal information for monetary compensation.

We do not use Project Data for third-party advertising.

3. Artificial Intelligence

RE includes artificial intelligence features designed to assist construction professionals with field documentation, project information, observations, recommendations, summaries, material requests, document retrieval, and other workflows.

When a user requests an AI-powered feature, relevant information may be sent to an artificial intelligence service provider for processing.

Depending on the feature, this information may include:

• User-entered text

• Voice transcriptions

• Photographs or information derived from photographs

• Video-related information

• Project context

• Observations

• Daily reports

• Inventory information

• Drawings

• Specifications

• Documents or relevant portions of documents

• Other information necessary to respond to the user's request

Rodrigues Ellis does not use customer Project Data to train generalized artificial intelligence models.

Our AI service providers may process information according to their applicable business or API data-processing terms. Where supported by the provider, Rodrigues Ellis uses business/API services under which customer API inputs and outputs are not used to train the provider's generalized models by default.

AI-generated information may contain errors, omissions, or incorrect recommendations. AI output is intended to assist qualified professionals and should not replace professional judgment, jobsite verification, applicable plans and specifications, manufacturer requirements, contractual requirements, engineering judgment, or applicable laws, codes, and safety standards.

4. Customer and Organization-Controlled Data

RE is designed as a business-to-business platform.

When you use RE through an employer, contractor, customer, or other organization, that organization may control the Project Data associated with its account.

Authorized organization administrators may be able to:

• View user information

• Assign or remove project access

• Manage user roles and permissions

• Access project records

• Review observations and reports

• Access photographs and videos

• Access time and attendance information

• Access inventory information

• Access AI-generated project information

• Retain or delete project records where permitted

Your organization's own privacy policies, employment policies, contracts, or other rules may also apply to its use of your information.

Questions concerning an organization's use of information should generally be directed to that organization.

5. How We Share Information

We may share information only as reasonably necessary to provide, secure, operate, and support the Services.

Within Your Organization

Project Data may be available to other users who have appropriate permissions within your organization or project.

Service Providers

We use third-party service providers to operate, secure, monitor, and support portions of the Services.

Our primary technology service providers include:

• Supabase — database infrastructure, authentication, file and media storage, and related backend services.

• OpenAI — artificial intelligence processing for RE Assistant, AI analysis, summaries, recommendations, document retrieval, and other AI-assisted features.

• Expo / EAS — application development, build, delivery, update, and related application infrastructure.

• Sentry — application error monitoring, crash reporting, performance monitoring, and diagnostics.

These service providers may process limited information necessary to perform their services.

Depending on the service and event involved, diagnostic information may include application errors, device or operating-system information, application version, technical identifiers, performance information, and contextual information necessary to diagnose a problem.

We configure our service providers and applications with the goal of limiting the collection of information to what is reasonably necessary to operate, secure, troubleshoot, and improve the Services.

These providers process information subject to their applicable contractual, security, and data-protection obligations.

Legal Requirements

We may disclose information if we reasonably believe disclosure is required to:

• Comply with applicable law, regulation, subpoena, court order, or legal process

• Respond to lawful requests from governmental authorities

• Protect the rights, property, or safety of Rodrigues Ellis, our customers, our users, or others

• Investigate fraud, security incidents, abuse, or violations of our agreements

• Establish, exercise, or defend legal claims

Business Transactions

If Rodrigues Ellis is involved in a merger, acquisition, financing, reorganization, sale of assets, or similar business transaction, information may be transferred as part of that transaction subject to applicable law and appropriate confidentiality protections.

6. Data Security

We use administrative, technical, and organizational safeguards designed to protect information against unauthorized access, disclosure, alteration, destruction, or misuse.

Depending on the system and information involved, safeguards may include:

• Authentication controls

• Role-based and project-based authorization

• Tenant isolation

• Database access policies

• Row-level security

• Private file storage

• Encryption in transit

• Secure API communication

• Application-layer authorization

• Security logging and monitoring

• Restricted administrative access

• Error and crash monitoring

No internet-connected system can be guaranteed to be completely secure. Users and organizations are responsible for protecting their credentials, maintaining appropriate device security, and promptly reporting suspected unauthorized access.

7. Data Retention

We retain information for as long as reasonably necessary to:

• Provide the Services

• Maintain customer and project records

• Fulfill contractual obligations

• Comply with legal requirements

• Resolve disputes

• Maintain security and audit records

• Enforce our agreements

Retention periods may vary depending on the type of information, customer requirements, contractual obligations, and applicable law.

Project Data may remain within an organization's account even after an individual user's account is removed when that information forms part of the organization's legitimate project, business, contractual, safety, accounting, or compliance records.

When information is no longer reasonably required, we may delete, anonymize, or securely dispose of it according to our retention practices and applicable law.

8. Account Deletion

Users may request deletion of their RE account by contacting Rodrigues Ellis at info@rodriguesellis.com.

Where account-deletion functionality is available within an RE application, users may also initiate an account-deletion request through the application's account or settings interface.

Deleting an individual user account does not necessarily require deletion of legitimate organization-controlled Project Data created or contributed by that user.

For example, construction observations, daily reports, time records, safety documentation, approvals, project photographs, videos, and other business records may need to remain available to the organization for legitimate business, contractual, safety, regulatory, or legal purposes.

Where required, personal account information that is not necessary for those purposes will be deleted, anonymized, or otherwise handled in accordance with applicable law.

9. Your Privacy Rights

Depending on where you live, you may have rights regarding your personal information, including the right to:

• Request access to certain personal information

• Request correction of inaccurate information

• Request deletion of certain information

• Request information about how your information is processed

• Object to or restrict certain processing

• Obtain a portable copy of certain information

• Withdraw consent where processing is based on consent

• Appeal certain privacy decisions where required by law

Some rights may be subject to exceptions under applicable law.

Because RE is primarily a business service, Rodrigues Ellis may process some information on behalf of a customer's organization. In those circumstances, we may direct your request to the organization that controls the applicable information.

10. California Privacy Rights

California residents may have additional rights under applicable California privacy laws.

Depending on applicability, these rights may include requesting information regarding categories of personal information collected, sources of information, purposes for collection or use, categories of recipients, and requesting access, correction, or deletion.

Rodrigues Ellis does not sell personal information for monetary compensation.

Rodrigues Ellis does not use customer Project Data for cross-context behavioral advertising.

We will not unlawfully discriminate against a user for exercising applicable privacy rights.

11. Children's Privacy

The Services are designed for businesses and professional users and are not directed to children under 13.

We do not knowingly collect personal information directly from children under 13 through individual RE accounts.

If we learn that we have collected personal information directly from a child in violation of applicable law, we will take reasonable steps to delete it.

12. International Data Processing

Rodrigues Ellis and our service providers may process or store information in the United States and other countries.

As a result, information may be processed in jurisdictions with data-protection laws that differ from those where you live or work.

Where required by applicable law, we use appropriate safeguards for international transfers of personal information.

13. Third-Party Services and Links

The Services may integrate with or contain links to third-party websites, applications, platforms, or services.

This Privacy Policy does not govern independent third-party services that users choose to access outside RE.

Third-party services are governed by their own privacy policies and terms.

14. Device Permissions

RE applications may request device permissions required to provide specific functionality, including:

• Camera access

• Photo and media-library access

• Microphone access

• Location access

• Notifications

Permissions are requested through your device operating system where required.

You may change many permissions through your device settings. Disabling a permission may prevent certain RE features from functioning properly.

15. Notifications

RE may send application notifications relating to project activity, work schedules, timekeeping, approvals, reminders, system events, or other relevant activity.

Users can manage application notification permissions through their device settings.

Some administrative or security communications may still be necessary to operate an account or protect the Services.

16. Data Ownership

As between Rodrigues Ellis and its business customers, customers retain their rights in the Project Data they submit to the Services, subject to the applicable customer agreement.

Rodrigues Ellis processes Project Data as necessary to provide, maintain, secure, support, and improve the Services as permitted by our agreements and applicable law.

Use of RE does not transfer ownership of a customer's construction drawings, specifications, photographs, videos, reports, observations, or other proprietary project information to Rodrigues Ellis.

17. Changes to This Privacy Policy

We may update this Privacy Policy periodically to reflect changes in our products, technology, business practices, legal requirements, or service providers.

When we make changes, we will update the “Last Updated” date at the top of this policy.

If changes materially affect how we process personal information, we may provide additional notice where required by law.

Continued use of the Services after an updated Privacy Policy becomes effective constitutes acknowledgment of the revised policy to the extent permitted by applicable law.
